PhD Research Seminar on: The Notion of ‘Attack’ in the Conduct of Hostilities War Crimes

Although the notion of “attack” has a clear treaty-based definition, the practice of international tribunals demonstrates a lack of consistency in its interpretation. This issue becomes particularly acute in cases where violence is committed on territory under the control of a party to the conflict: do such acts necessarily fall outside the qualification of “attacks”? Does the concept require a special, broader meaning for certain war crimes provisions?
