PhD Research Seminar on: “Applying the Legitimate Interests Basis to Web-Scraped AI Training”

The application of the “legitimate interests” basis under Article 6(1)(f) of the GDPR in the context of training AI systems remains the subject of ongoing academic and regulatory debate. Particularly complex issues arise when it comes to mass web scraping of data for the training of the AI systems: can the three-part legitimate interests test be applied to such web scraping and ensure the proper protection of personal data?

How to achieve a fair balance between the interests of technology developers, the needs of innovation, and the fundamental rights of data subjects – a balance that would allow developers of generative AI to adhere to the principles of personal data protection while maintaining the technological viability of their projects?
