European labor law (in English)

The course “European labor law” is an elective component of the educational program, a cycle of professional training disciplines for master’s students, which contributes to the training of legal specialists. During the course, students learn the basic provisions of European labor law, which is taught from the perspective of understanding labor rights as human rights. A distinctive feature of this course is that it combines the provisions of EU and Council of Europe labor law, the practice of the EU Court and the ECHR, judicial (EU Court, ECHR) and quasi-judicial practice of the European Committee of Social Rights. An important component of the course is the analysis and comparison of the provisions of European labor law and the national labor law of Ukraine. The course uses resources from the Council of Europe’s HELP (Human Rights Education for Legal Professionals) educational platform, and the main source of law is the European Social Charter. Successful mastery of the course material requires not only knowledge of the relevant provisions of European labor law, but also the ability to apply the acquired knowledge in various legal situations, the ability to form well-founded legal conclusions regarding the protection of workers’ labor rights, taking into account the provisions of the European Social Charter, the European Convention on Human Rights, the practice of the ECHR and the ECSR, identifying cases of violation of the rule of law and non-compliance of national labor legislation with the provisions of EU directives in the field of labor law, taking into account the practice of the EU Court of Justice.
