Introduction to mediation
The course introduces students to the theory, regulatory framework, and practice of mediation in order to develop future lawyers’ values, readiness, and understanding of how to apply mediation in their practical work. To this end, within the course, students acquire the competencies necessary for qualified participation in mediation as a lawyer who appropriately offers the client to participate in mediation and/or provides support to the client participating in mediation. At the same time, such a specialist is familiar with the requirements of the relevant Law of Ukraine “On Mediation,” distinguishes mediation from other methods of alternative dispute resolution, and is knowledgeable about the requirements of special legislation regulating the use of mediation and other restorative practices in various types of legal relations.
In order for students to properly understand mediation as one of the consensual approaches to dispute resolution, it would be appropriate to first complete the course “Basic dispute resolution skills.”
