At the international level about national decisions: representatives of the Faculty at the Council of Europe conference in Strasbourg

On 17 March, Dr Volodymyr Venher, Dean of the Faculty of Law at the National University of Kyiv-Mohyla Academy (NaUKMA), and Pavlo Pushkar, faculty member at the Department of International and European Law, took part in the international conference “Better Enforcement of National Judicial Decisions: A Human Rights and Rule of Law Requirement”, held at the Council of Europe headquarters in Strasbourg. The event was jointly organised by the Council of Europe and the Ministry of Justice of Luxembourg under the auspices of the Luxembourg Presidency of the Committee of Ministers of the Council of Europe.
During Panel 2, dedicated to challenges related to systemic and structural issues of non-enforcement of domestic judgments, Dr Volodymyr Venher delivered an online presentation on the rule of law as a key prerequisite for improving the enforcement of court decisions in Ukraine. Pavlo Pushkar, Head of Division at the Department for the Execution of Judgments of the European Court of Human Rights, also participated in this panel. He described the event as “a conference of the conferences” — as the enforcement of court decisions remains a cornerstone of access to justice and compliance with the rule of law.
As Pavlo Pushkar noted, it is time to strengthen European standards in this area:
“Judgments must be enforced — and as Frank Herbert said, ‘spice must flow’ and thus we do need ‘better enforcement of national judgments’ to ensure better implementation of the European Convention on Human Rights and the catalogue of rights under the Convention at the domestic level.”
