The Rule of Law and Human Rights in the Convention for the Protection of Human Rights and Fundamental Freedoms (supported by USAID “Fair Justice”)
The main objective of the project was to analyze the court decisions. The experts analyzed more than 2000 decisions of Ukrainian courts of all instances and specializations.. Based on the results of this analysis, 230 decisions were proportionally selected, representing different instances and specializations, and, most importantly, clearly demonstrating the level of implementation of the principle of the rule of law and its components in court practice.
Based on the results of the analytical review of the judicial practice, two training programs for judges were prepared regarding the peculiarities of implementation of the rule of law and its components in practice.. These programs are to be used by the National School of Judges of Ukraine in the training of judges and candidates for the positions of judges.
The practical significance of the training programs and this research project in general is also manifested in the need to form and develop the modern understanding of the rule of law among judges (or future judges) based on the understanding of its main components: respect for human rights and freedoms and their crucial importance in the relationship with the state (alternatively: their binding nature for the state); the supreme legal force of the constitution, equality before the law, legal clarity and legal certainty, legality, proportionality, access to independent and impartial justice, etc.
