Can the Ukrainian Government Waive Its Claims for Reparations for International Crimes, as Demanded by Russia in the Context of Peace Negotiations?

The European Journal of International Law ( EJIL: Talk! ) blog has published an article by Maksym Vishchyk, faculty member of the Faculty of Law at National University of Kyiv-Mohyla Academy, co-authored with Jeremy Pizzi, entitled “A Duty to Fight for Your Nationals? Ukraine and the Future of Reparation Claims.”
The article explores whether international law not only grants Ukraine the sovereign right to claim reparations for its citizens who have suffered from the gravest human rights violations and international crimes, but also imposes a duty on the state to pursue such claims.
The authors conclude that, in response to Russia’s demands to waive reparations, Ukraine can argue that it is legally bound never to do so—because of its duty toward its own citizens.
